This section of the Drive lah Insurance Policy outlines your responsibilities and potential liabilities in the unfortunate event of a vehicle accident during your rental period.
1.0 Guest Liability in Case of a Non-Fault Accident:
Subject only to the determination by the appropriate authorities that an accident was not your fault, you acknowledge that you will be immediately liable for the following:
Rental and Downtime Fees: The full amount of the rental fees for the entire rental period and the period the vehicle is unusable due to the accident. This includes the time taken to report the accident and the time required for processing and repairing the vehicle.
Towing Costs: Towing fees and costs if the vehicle is deemed unsafe or unable to be driven.
Insurance Excess: Any insurance excess amount payable as a result of the accident.
1.1 Failure to Report Accident Properly:
If you fail to report the accident to the designated Accident Reporting Centre as required or do not provide the necessary information and assistance to Drive Lah, all insurance coverage will be void.
1.2 Reporting Damages and Accidents:
You are required to report any damages or accidents either during the incident or within 24 hours of occurrence. Failure to do so will nullify your insurance coverage and any additional protection add-ons you may have purchased. This rule also applies if the vehicle is left unattended during an accident.
1.3 Misleading Information:
Any deliberate provision of misleading or false information by either the guest or host will result in the nullification of insurance coverage and removal from the platform. All relevant fees will be charged to the responsible party.
1.4 Comprehensive Accident Report:
Failure to submit a comprehensive accident report, as previously mentioned, or failing to provide written documentation in the case of a private settlement can void your insurance.
If a Host declines to cooperate, insurance coverage may be forfeited, and Drive lah will not oversee vehicle repairs. It is crucial that Guests follow the established accident reporting process to maintain any benefits of excess reduction.
1.5 Exclusions to Coverage:
You will be liable for the full cost of repairs or replacement and any other applicable fees if any of the exclusions to insurance coverage apply (refer to the full Insurance Policy for details).
1.6 Standard and Additional Excess Amounts:
The standard insurance excess for all incidents is $3000 plus GST (for both Section I: Damage to the rented vehicle, and Section II: Third-party liability).
Note: For cars aged above 12 years, only third-party insurance is offered with the standard excess of $3000 plus GST.
Any amount exceeding this standard excess is borne by the Host.
